Please read these terms carefully before using ClearPoint Home Services.

These Terms of Service ("Terms") govern your use of ClearPoint Home Services' website and services. By booking or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

1. Acceptance of Terms

By accessing our website, booking our services, or using any of our platforms, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and ClearPoint Home Services.

If you are booking services on behalf of a business or organization, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Services Description

ClearPoint Home Services is a managed service provider that connects clients with independent contractors for residential cleaning services. We offer:

  • Standard Cleaning: Regular maintenance cleaning services
  • Deep Cleaning: Comprehensive top-to-bottom cleaning services
  • Move-In/Out Cleaning: Complete property cleaning for relocations

We manage the booking process, quality control, customer support, and payment processing. The actual cleaning services are performed by independent contractors in our network.

3. Booking and Payment

Booking Process

You may book services through our website or by contacting us directly. By submitting a booking request, you are making an offer to purchase services at the quoted price. Your booking is confirmed once we accept your request and process payment.

Pricing

All prices are listed in U.S. Dollars and are subject to change without notice. The price quoted at the time of booking is the price you will pay, unless:

  • Your property is significantly larger than indicated in the booking
  • The condition of your property requires substantially more work than anticipated
  • You request additional services beyond the original scope

In such cases, we will contact you for approval before proceeding with any additional charges.

Payment Terms

Payment is due at the time of booking confirmation. We accept major credit cards and debit cards. All payments are processed through secure third-party payment processors.

By providing payment information, you represent and warrant that you are authorized to use the payment method provided and authorize us to charge the full amount of the services.

4. Cancellation and Rescheduling

Cancellation by Client

  • More than 24 hours notice: Full refund of payment
  • Less than 24 hours notice: Cancellation fee may apply (up to 50% of service cost)
  • No-show/same-day cancellation: No refund

Rescheduling

You may reschedule your appointment with at least 24 hours' notice at no additional charge. Rescheduling requests with less than 24 hours' notice may incur a fee.

Cancellation by ClearPoint

We reserve the right to cancel or reschedule services due to circumstances beyond our control (weather, contractor illness, emergencies, etc.). In such cases, we will provide as much notice as possible and offer to reschedule or provide a full refund.

5. Your Responsibilities

As a client, you agree to:

  • Provide accurate information about your property size, condition, and service requirements
  • Ensure safe access to your property on the scheduled service date
  • Secure or remove valuable, fragile, or sentimental items before service
  • Provide adequate lighting, water, and electricity for service completion
  • Notify us of any hazardous conditions (mold, pests, structural damage, etc.)
  • Secure pets in a separate area during service or notify us in advance
  • Treat our contractors with respect and professionalism
  • Provide parking information or accommodate parking needs when applicable

Failure to meet these responsibilities may result in service delays, additional charges, or cancellation without refund.

6. Independent Contractors

The cleaning professionals who perform services are independent contractors, not employees of ClearPoint Home Services. They operate as independent businesses and are responsible for:

  • Providing their own supplies, equipment, and tools
  • Maintaining appropriate insurance coverage
  • Paying their own taxes as independent contractors (1099 basis)
  • Managing their own schedules and accepting jobs at their discretion

ClearPoint Home Services acts as a managed service provider, handling booking, payment processing, quality assurance, and customer support. We carefully review all contractors in our network but do not control the day-to-day actions of independent contractors.

7. Liability and Damages

Damage Claims

While rare, if damage occurs during service:

  • You must report damage within 24 hours of service completion
  • Provide photographic evidence and detailed description
  • We will investigate and work with you to resolve the issue fairly
  • Our liability is limited to the actual cost of repair or replacement, up to the amount paid for the service

Limitations

ClearPoint Home Services is not liable for:

  • Pre-existing damage or wear not reported before service
  • Damage to items not properly secured or removed before service
  • Loss or theft of valuables left unsecured during service
  • Damage resulting from hidden defects or fragile items not identified
  • Consequential, indirect, or incidental damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE SERVICE IN QUESTION.

8. Satisfaction Guarantee

We stand behind the quality of our services. If you are not satisfied with the service provided:

  • Contact us within 24 hours of service completion
  • Describe the specific areas or issues of concern
  • We will send a professional back to address the issue at no additional charge
  • If we cannot resolve the issue to your satisfaction, we may offer a partial or full refund at our discretion

Important: Satisfaction issues must be reported within 24 hours of service completion to qualify for our guarantee. This guarantee does not apply if you fail to provide accurate property information, deny access for re-service, or if issues result from circumstances beyond our control.

9. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of ClearPoint Home Services and is protected by copyright and trademark laws.

You may not copy, reproduce, distribute, modify, or create derivative works from our content without our express written permission.

10. Termination

We reserve the right to refuse service or terminate our relationship with any client who:

  • Violates these Terms of Service
  • Provides false or misleading information
  • Engages in abusive, threatening, or inappropriate behavior toward our staff or contractors
  • Repeatedly cancels or no-shows for scheduled services
  • Requests illegal or inappropriate services
  • Creates unsafe working conditions

Termination does not relieve you of payment obligations for services already rendered or scheduled.

11. Dispute Resolution

Informal Resolution

If you have a dispute or concern, please contact us first. We are committed to resolving issues promptly and fairly through direct communication.

Arbitration

If we cannot resolve a dispute informally, you agree that any claims or disputes will be resolved through binding arbitration rather than in court, except where prohibited by law. Arbitration will be conducted by a neutral arbitrator in accordance with applicable arbitration rules.

Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as part of a class action, consolidated action, or representative action.

12. Changes to Terms

We may update these Terms of Service from time to time. Changes will be effective immediately upon posting to our website with a new "Last Updated" date. Material changes will be communicated via:

  • Prominent notice on our website
  • Email notification (if we have your email address)

Your continued use of our services after changes are posted constitutes acceptance of the updated Terms. If you do not agree with the changes, you should discontinue use of our services.

Entire Agreement
